Terms and Conditions for Sərfəli

1. Agreement to Terms

By downloading, accessing, or using the Sərfəli application (the "App"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you are prohibited from using the App.

2. Use of the Application

Sərfəli provides a platform to discover deals, sales, and discounts at various third-party retailers, and to create collaborative family shopping lists.

• You must be at least 13 years old to use the App.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree not to use the App for any illegal or unauthorized purpose, nor to violate any laws in your jurisdiction.

3. Third-Party Retailers, Prices, and Deals

Sərfəli does not sell products directly. The App only provides information about discounts and deals. All purchases are completed outside the App with third-party retailers.

We do not guarantee that users will achieve savings or price advantages by using the App. The information provided in the App is for informational purposes only and should not be considered financial or purchasing advice. Some deal information may be obtained from publicly available sources or third parties. We are not responsible for inaccuracies in such information.

• Accuracy of Deals: While we strive to provide accurate and up-to-date information, we do not guarantee the availability, price, or terms of any deals, products, or items listed on the App. Offers, availability, and prices are subject to change without notice by the respective third-party retailers.
• No Endorsement: Sərfəli is not affiliated with, nor does it explicitly endorse, the third-party brands and retailers listed, unless otherwise specified.
• Transactions & Disputes: Any transactions or dealings you have with third-party retailers found through the App are strictly between you and the retailer. We are not a party to those transactions and are not responsible or liable for any loss, damage, or dispute incurred as a result of such dealings.

4. User-Generated Content (Family Lists, Search, etc.)

• You retain ownership of the content you create (such as lists or notes), but you grant us a license to host, display, and process this data to provide the App's services.
• You agree not to upload harmful, offensive, or malicious content. We reserve the right to remove any content or terminate accounts that violate this policy.

5. Intellectual Property

All original content, features, and functionality on the App (including text, graphics, logos, and software) are the exclusive property of Sərfəli or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary content without our express written permission.

6. Limitation of Liability

To the fullest extent permitted by law, Sərfəli, its developers, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the App, your inability to use the App, or your reliance on any information provided on the App.

Disclaimer of Warranties: We provide the application strictly on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Indemnification

You agree to defend, indemnify, and hold harmless Sərfəli, its affiliates, developers, and agents from and against any claims, actions, or demands, including reasonable legal and accounting fees, arising or resulting from your breach of these Terms or your access to, use, or misuse of the App.

8. Service Availability

We do not guarantee that the App will always be available or operate without interruptions.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

10. Modifications to the Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of any changes by updating the "Last Updated" date of these Terms. Your continued use of the App after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by them.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Azerbaijan, without regard to its conflict of law provisions.
